Welcome to GoodToGo Portables. These Terms of Service ("Terms") govern your use of our website and services. By accessing our website or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.
1. Services Overview
GoodToGo Portables ("Company," "we," "our," or "us") provides portable toilet rentals and related sanitation services. We operate through a network of local service partners across the United States.
2. Eligibility
To use our services, you must:
- Be at least 18 years of age
- Have the legal authority to enter into a binding agreement
- Provide accurate and complete information when placing orders
- Have authorization to place equipment at the specified delivery location
3. Orders and Pricing
3.1 Quotes and Pricing
All quotes provided through our website or by phone are estimates based on the information you provide. Final pricing may vary based on actual service requirements, location, permit fees, and other factors. We will confirm final pricing before processing your order.
3.2 Order Confirmation
Your order is not confirmed until you receive written confirmation (via email or text) from us. We reserve the right to decline any order at our discretion.
3.3 Payment Terms
Payment is due as specified in your order confirmation. We accept major credit cards and other payment methods as indicated during checkout. For commercial accounts, net payment terms may be available upon credit approval.
4. Delivery and Pickup
4.1 Delivery
You are responsible for ensuring that the delivery location is accessible and suitable for equipment placement. This includes:
- Clear access for delivery vehicles
- Level, stable ground for equipment placement
- Adequate overhead clearance
- Compliance with local regulations and HOA rules
4.2 Delivery Windows
While we strive to meet requested delivery times, delivery windows are estimates and not guarantees. We will notify you if delays occur. Same-day delivery is subject to availability and location.
4.3 Pickup
Pickup will occur on the scheduled date unless you request an extension. Equipment must be accessible for pickup. Additional fees may apply if pickup is delayed due to blocked access or other issues within your control.
5. Equipment Use and Restrictions
5.1 Acceptable Use
Equipment must be used only for its intended purpose and in accordance with all applicable laws and regulations.
5.2 Equipment Care
Portable toilet equipment must be used appropriately and kept in reasonable condition. Damage resulting from misuse, vandalism, or placement of prohibited items may result in additional fees or charges.
6. Rental Period and Extensions
The rental period begins on the delivery date and ends on the scheduled pickup date. Extensions are available upon request and may incur additional daily fees. Please contact us at least 24 hours before your scheduled pickup if you need an extension.
7. Cancellation and Refunds
7.1 Cancellation by Customer
- Before Delivery: Cancellations made more than 24 hours before scheduled delivery will receive a full refund. Cancellations within 24 hours may incur a cancellation fee.
- After Delivery: Once equipment is delivered, rental fees are non-refundable. Early pickup may be arranged but does not reduce rental charges.
7.2 Cancellation by Company
We reserve the right to cancel orders due to service area limitations, equipment unavailability, or other operational reasons. In such cases, you will receive a full refund of any payments made.
8. Damage and Liability
8.1 Customer Responsibility
You are responsible for:
- Damage to equipment caused by misuse, negligence, or prohibited items
- Damage to property at the delivery location (including driveways, landscaping, and structures)
- Ensuring equipment is not moved from its delivery location without authorization
- Theft or vandalism of equipment while in your possession
8.2 Property Protection
Equipment placement may affect lawns and soft surfaces. We are not liable for surface wear under normal use conditions.
8.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOODTOGO PORTABLES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OUR SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.
9. Permits
If equipment will be placed on public property (streets, sidewalks, rights-of-way), you may need a permit from local authorities. We can assist with permit applications in many areas, but you are ultimately responsible for obtaining required permits. Permit fees are typically in addition to rental costs.
10. Indemnification
You agree to indemnify and hold harmless GoodToGo Portables, its affiliates, partners, and employees from any claims, damages, or expenses arising from your use of our services, violation of these Terms, or infringement of any third-party rights.
11. Dispute Resolution
11.1 Informal Resolution
Before initiating any legal action, you agree to contact us and attempt to resolve any dispute informally for at least 30 days.
11.2 Governing Law
These Terms are governed by the laws of the State of New York without regard to conflict of law principles.
11.3 Arbitration
Any disputes not resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Class action lawsuits and class arbitrations are not permitted.
12. Modifications to Terms
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website. Continued use of our services after changes constitutes acceptance of the modified Terms.
13. Website Use
13.1 Intellectual Property
All content on our website, including text, graphics, logos, and software, is the property of GoodToGo Portables and protected by copyright and trademark laws.
13.2 Prohibited Activities
You may not:
- Use our website for any unlawful purpose
